1. Introduction & purpose

This manual is published in terms of section 51 of the Promotion of Access to Information Act, 2000 ("PAIA"). It explains what records HOWZIT CLUB (Pty) Ltd ("HOWZIT", "we", "us") holds and how a person may request access to them. It also incorporates information about how we process personal information under the Protection of Personal Information Act, 2013 ("POPIA").

Records are also kept in terms of, among others: the Companies Act 71 of 2008, the Income Tax Act 58 of 1962 and the Tax Administration Act 28 of 2011, the Value-Added Tax Act 89 of 1991 (if applicable), the Basic Conditions of Employment Act 75 of 1997 (if applicable), and POPIA.

7. Processing of personal information (POPIA)

We process personal information as described in our Privacy Policy, which sets out the purposes, categories of data subjects and personal information, recipients (including service providers and, for opted-in Android users, Meta Platforms for advertising measurement), cross-border transfers and safeguards, retention, security measures, and data-subject rights. Data subjects may exercise their POPIA rights (access, correction, deletion, objection, withdrawal of consent) by contacting the Information Officer above.

8. How to request access to a record

  1. Complete the prescribed Form 2 (Request for Access to Record of Private Body) under the PAIA Regulations (available from us on request, or from the Information Regulator's website).
  2. Send the completed form to the Information Officer at the contact details in section 2.
  3. Provide sufficient detail to identify the record and the form of access required, together with proof of identity.
  4. If the request is on behalf of another person, submit proof of your authority to act.

Fees: a request fee and an access fee may be payable as prescribed in the PAIA Regulations. We will notify you of any fee before processing the request.

Decision time: we will decide within 30 days of receiving the request (extendable by a further 30 days in certain circumstances, with notice to you).

9. Grounds for refusal

Access may be refused on the grounds set out in Chapter 4 of PAIA, including (among others) the mandatory protection of the privacy of a third party who is a natural person, commercial information of a third party, confidential information, and records privileged from production in legal proceedings.

10. Remedies

If a request is refused, the requester may apply to a court as provided for in PAIA, or lodge a complaint with the Information Regulator (PAIAComplaints@inforegulator.org.za).
